1. general


1.1 The company Tyrell Bike Deutschland (hereinafter referred to as ‘TYRELL’) offers items for sale to buyers via the online shop tyrellbike.de.


1.2 The following General Terms and Conditions (GTC) apply to all business relationships between the buyer and TYRELL that are established via the online shop.


1.3 These GTC apply both to entrepreneurs within the meaning of § 14 BGB and to consumers within the meaning of § 13 BGB. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.


2 Offer, acceptance and conclusion of contract


2.1 The product descriptions contained in TYRELL's online shop do not constitute binding offers, but serve to submit a binding offer by the buyer.


2.2 The buyer can initially place the products in the shopping basket without obligation and correct his entries at any time before submitting the order. Before finally clicking on the ‘Order with obligation to pay’ button, the buyer has the opportunity to check all details and correct them if necessary.


2.3 After sending the order, the buyer receives an automatic confirmation by e-mail, which documents the receipt of the order, but does not yet constitute acceptance of the offer.


2.4 The contract is concluded depending on the payment method selected:


PayPal: The buyer is redirected to the PayPal website, where he enters his payment details and confirms the payment instruction. The contract is concluded as soon as TYRELL requests PayPal to initiate the payment transaction.


Prepayment: The contract is concluded as soon as TYRELL sends the buyer a declaration of acceptance and the bank details by e-mail.


Credit card: The buyer transmits his credit card details with the order. After successful verification and legitimisation, the payment is executed and the contract is concluded.


2.5 If an order cannot be accepted, the buyer will be informed immediately. In this case, payments already made will be refunded immediately.


3. dispatch


3.1 In the case of entrepreneurs, the risk of accidental loss and accidental deterioration of the goods shall pass to the buyer upon handover to the transport company. In the case of consumers, the transfer of risk shall not take place until the goods are handed over to the buyer.


3.2 If delivery is impossible due to force majeure or other unforeseeable events, the order will be cancelled. TYRELL will inform the buyer immediately and refund any payments already made.


4 Terms of payment and prices


4.1 All prices in the online shop are total prices and include the statutory value added tax. Any shipping costs are shown separately.


4.2 The purchase price is due upon delivery of the goods and receipt of the invoice, except in the case of advance payment.


4.3 The following payment methods are available:


Prepayment: Delivery takes place after receipt of payment.


PayPal: Payment is made directly via the online provider.


Credit card: Payment is made after successful verification of the credit card details.


5. notification of transport damage


5.1 The buyer is requested to report obvious transport damage to the deliverer and TYRELL as soon as possible. This serves to enforce claims against the transport company or the transport insurance.


5.2 The following applies to entrepreneurs: Loss or damage must be reported within ten days of delivery in order to assert claims in good time.


5.3 Consumer rights remain unaffected by these regulations.


6 Retention of title


6.1 The goods remain the property of TYRELL until full payment has been made.


6.2 In the case of entrepreneurs, the goods remain the property of TYRELL until all claims arising from the current business relationship have been settled.


6.3 The buyer is obliged to inform TYRELL immediately of any seizure by third parties or damage to the goods.


7 Warranty and guarantee conditions


7.1 The statutory warranty rights apply.


7.2 Wear and tear and signs of use resulting from normal use are excluded from the warranty.


7.3 TYRELL does not give any guarantees of its own. Manufacturer warranties remain unaffected.

8 Complaints procedure

TYRELL is not willing and not obliged to participate in dispute resolution proceedings before consumer arbitration boards.




9. final provisions


9.1 The contract language is German.


9.2 The text of the contract is stored by TYRELL. The processing of personal data is carried out in accordance with the GDPR. Further information can be found in the privacy policy.


9.3 German law applies, unless this contradicts the mandatory law of the consumer's country of residence.


9.4 The place of jurisdiction for entrepreneurs is the registered office of TYRELL.
